Answers to common patent search and registration questions

To be patentable, an invention must be novel (new), involve an inventive step (non-obvious to a person skilled in the art), and be capable of industrial application. It must not fall under non-patentable categories listed in Section 3 and 4 of the Indian Patents Act, 1970.

A Provisional Application is filed when an invention is still under development to lock in an early priority date at lower cost. A Complete Application contains full technical claims and detailed specifications, which must be filed within 12 months of the provisional filing.

In India, a granted patent is valid for 20 years from the date of filing the application (or priority date), provided annual renewal fees are paid continuously starting from the 3rd year onwards.

Under Section 3(k) of the Indian Patent Act, software per se or computer algorithms are not patentable. However, software tied to new hardware or producing a technical effect/technical contribution can be patented with expert claim drafting.
