No, registration of a Will is optional under Section 18 of the Registration Act, 1908. A Will written on plain paper signed by the testator in the presence of two witnesses is legally valid. However, registering it before a Sub-Registrar provides strong authenticity proof and prevents forgery claims.

A Will takes effect only after the death of the person making it, and can be changed or cancelled anytime during their lifetime without stamp duty. A Gift Deed transfers property immediately during the lifetime of the donor, requires registration with stamp duty, and cannot be revoked once accepted.

Probate is a court certificate establishing the legal validity of a Will. It is mandatory for properties situated in presidential cities like Mumbai, Kolkata, and Chennai, or for Wills executed within these jurisdictions. It is also required by many municipal authorities and societies before transferring property mutation.
